By enrolling as an Affiliate, Member, or User, you acknowledge that you have read, understood, and agree to these Terms and the Fenix Affiliates Privacy Policy.

Fenix Affiliates Inc. reserves the right to modify these Terms at any time. Continued participation or use of the website after updates constitutes acceptance of the revised Terms.

2. Nature of Services

Fenix Affiliates Inc. operates as a membership-based affiliate program offering educational tools, financial literacy resources, and commission opportunities through referrals to partner companies, including Accounting Connections Group, Credit Connections Inc., Innovative Business Connections LLLC, and Quantum Innovative Enterprises.

The services may include, but are not limited to:

• Affiliate education, onboarding, and marketing tools.
• Commission structures tied to successful client referrals.
• Access to digital materials and coaching content.
• Member support and compliance resources.

Fenix Affiliates Inc. is not a financial, legal, or credit services organization and does not directly offer credit repair or lending services.

3. Intellectual Property Rights

All content, materials, trademarks, logos, guides, digital courses, videos, and proprietary systems made available by Fenix Affiliates Inc. are the intellectual property of the Company or its licensors.

You may not:

• Copy, reproduce, or redistribute materials without written permission.
• Modify, resell, or use Company resources for non-affiliate commercial purposes.
• Share internal training materials or portal access credentials.

Violation of these rights may result in termination and potential legal action.

4. Affiliate Conduct & Obligations

As an Affiliate or Member, you agree to:

• Represent Fenix Affiliates Inc. ethically, lawfully, and transparently.
• Avoid false, misleading, or exaggerated claims about earnings, services, or partnerships.
• Refrain from providing credit, legal, or financial advice to clients unless properly licensed.
• Follow the Company’s Brand Guidelines and Compliance Manual, where applicable.
• Report any suspected misuse, fraud, or unauthorized sharing of materials.

Prohibited conduct includes, but is not limited to:

• Promoting illegal or deceptive schemes.
• Using Fenix branding for unrelated commercial activity.
• Misrepresenting partnerships or commission terms.

5. Membership, Payment & Refund Policy

Certain services require a paid membership or subscription. All payments are due at the time of enrollment and are processed through authorized third-party providers.

All membership and service fees are non-refundable once payment is processed, unless expressly stated otherwise in a separate written agreement.

Members may cancel at any time. Cancellation forfeits access to affiliate tools, commissions, and resources effective immediately upon termination.

6. Commission Program

Affiliates may earn commissions on valid referrals in accordance with the Fenix Affiliates Commission Plan in effect at the time of the referral.

Commissions are contingent upon:

• Active membership and good standing with Fenix Affiliates Inc.
• Verified referral through approved partner links or systems.
• Compliance with all applicable laws and Fenix Affiliates guidelines.

The Company reserves the right to adjust commission structures, qualification requirements, or payout schedules at any time.

7. Limitation of Liability

To the fullest extent permitted by law, Fenix Affiliates Inc. and its affiliates shall not be liable for:

• Indirect, incidental, or consequential damages arising from use of the website or services.
• Losses related to business interruption, data, profits, or reputation.
• Third-party system outages, payment processor errors, or partner platform malfunctions.

If liability is ever imposed, total liability shall not exceed the membership fee or commission amount paid to you within the prior six months.

8. No Guarantee of Earnings

Fenix Affiliates Inc. makes no income, success, or performance guarantees. Earnings depend on each Affiliate’s effort, skill, and adherence to compliance standards.

Any income examples provided are for illustration only and do not represent typical or guaranteed results.

9. Indemnification

You agree to indemnify, defend, and hold harmless Fenix Affiliates Inc., its officers, employees, and affiliates from any claims, damages, or expenses, including reasonable attorney fees, arising from:

• Your breach of these Terms.
• Your misuse of Company materials or intellectual property.
• Your violation of any applicable laws or third-party rights.

10. Termination of Membership or Access

We reserve the right to suspend or terminate your account without notice if:

• You breach these Terms or violate compliance standards.
• You engage in unethical or illegal activity.
• You misuse confidential materials or intellectual property.

Termination may result in forfeiture of commissions, access rights, or other benefits.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.

All disputes will first be addressed through good-faith mediation. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association in Colorado Springs, Colorado.

You waive your right to participate in any class-action lawsuit against Fenix Affiliates Inc.

12. No Warranties

The website and services are provided “as is” and “as available.”

Fenix Affiliates Inc. makes no warranties, express or implied, regarding:

• The availability, accuracy, or completeness of materials.
• That access will be uninterrupted, secure, or error-free.
• That results or earnings will meet any specific expectations.

13. Changes to Terms

We reserve the right to amend or update these Terms at any time. It is your responsibility to review them periodically. Continued participation constitutes acceptance of any changes.
